CHAPTER 9: Preparing for the Trial Step One: Gathering and Analyzing Evidence

Gathering and analyzing evidence sounds extremely technical and overwhelming, but truly it is not. This is when your folder with all your notes will be important. In some traffic cases, you will have multiple pieces of discovery, evidence, and photographs to keep track of; in others, you will only have a few.

Start by determining how you will stay organized. Use a notebook or legal pad to track all your notes regarding phone calls, requests, and documents you have received. Then, you will start by gathering and analyzing evidence.

Start by requesting discovery — this will show how the officer gathered information in order to issue you a ticket, such as measuring your speed. This chapter will use the specific example of fighting a speeding ticket. You will understand how to interview your witnesses, make the most of your previously taken notes, and learn what the proper use of photos and diagrams are in the courtroom. The different ways that speed is measured, and each method’s margin of error, was previously discussed in Chapter 5.
